Terms of Service

These Terms of Service ("Terms") govern your use of tinkerforgelabs.com and the apps, browser extensions, software, and online services offered by Tinkerforge Labs ("we", "us") (together, the "Services"). By using the Services you agree to these Terms. If you do not agree, do not use the Services. Some products have additional terms, and those terms apply alongside these.

1. Eligibility and accounts

You must be at least 13 years old to use the Services, and old enough to form a binding contract where you live to make a purchase. You are responsible for your account credentials and for all activity under your account. Tell us right away if you suspect unauthorized use.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or internal business purposes. We and our licensors keep all rights, title, and interest in the Services. You may not copy, modify, resell, reverse engineer, or create derivative works of the Services except where the law allows it.

3. Acceptable use

You agree not to:

• Break any law or infringe anyone's rights while using the Services
• Upload malware or try to disrupt, overload, or gain unauthorized access to the Services
• Scrape, resell, or share access to the Services without our permission
• Use the Services to send spam or to harass or harm others

4. Purchases, subscriptions, and billing

Prices and billing terms are shown before checkout. Stripe processes payments on our behalf. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You can cancel at any time from your account or by emailing us, and cancellation takes effect at the end of the current billing period. We will give you notice before any price change takes effect for an existing subscription. You are responsible for any applicable taxes.

5. Refunds

If a product does not work as described, email support@tinkerforgelabs.com within 14 days of purchase and we will either fix the problem or refund you. Outside that window, partial billing periods are not refunded unless the law requires it. Purchases made through a third-party app store follow that store's refund policy.

6. Your content

You keep ownership of any content you submit to the Services. You grant us a license to host, store, and process that content only as needed to operate the Services for you.

7. Feedback

If you send us suggestions or feedback, we may use them without any obligation to you.

8. Third-party services

The Services may link to or work with third-party websites and services. We do not control them and are not responsible for their content or practices.

9. Termination

You may stop using the Services at any time. We may suspend or end your access if you violate these Terms or if we discontinue a product. If we discontinue a paid product, we will refund any prepaid amount for the unused period.

10. Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TINKERFORGE LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $100.

12. Indemnification

You agree to indemnify and hold harmless Tinkerforge Labs from claims, damages, and expenses, including reasonable attorneys' fees, arising from your misuse of the Services or your violation of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the "Last updated" date. If you keep using the Services after a change takes effect, you accept the updated Terms.
